The terms for using Rafeeq

These Terms of Service (the "Terms") constitute a legally binding agreement between you (the "User" or "Customer") and Rafeeq (the "Platform", "Service", "we", "us", or "our"). By creating an account, paying for a subscription, or using the Rafeeq platform, you unreservedly agree to be bound by these Terms. If you do not agree to these terms in their entirety, you must immediately cease use of the Service.

Section 1

Description of Services

Rafeeq is an AI-powered software platform designed to automate customer conversations. We provide the infrastructure and dashboard that allow businesses to deploy AI agents across various messaging channels, prominently including WhatsApp.

The Service acts strictly as a technical bridge between your business and your customers via third-party messaging providers. Features, usage limits, and capabilities are dictated by your chosen subscription plan.

Section 2

Absolute Waiver of Liability for Third-Party Bans and Suspensions

Rafeeq relies on integrations with third-party platforms (e.g., Meta, WhatsApp, Instagram, LinkedIn). You acknowledge and agree that you are solely and entirely responsible for complying with the terms, policies, and commerce guidelines of these third-party providers.

  • No Liability for Account Bans: Under no circumstances shall Rafeeq be held liable if your phone number, business manager, WhatsApp Business account, or any other connected third-party account is restricted, temporarily suspended, shadow-banned, or permanently disabled.
  • Customer Responsibility:It is your strict responsibility to ensure you have explicitly collected customer opt-ins, comply with local spam laws, and adhere to WhatsApp's specific messaging limits and content policies.
  • Service Unavailability: If a third party modifies its API, changes its pricing, or revokes your access, Rafeeq is not responsible for any resulting loss of functionality.

Section 3

Strict No-Refund Policy

All purchases, subscriptions, and usage-based charges are 100% final and non-refundable.

Zero Exceptions: Under no circumstances will any money be returned, credited, or prorated. This includes, but is not limited to:

  • You forgetting to cancel your subscription prior to renewal.
  • Your WhatsApp or third-party account being banned or restricted.
  • Your failure or inability to use the Service.
  • Temporary service downtimes, bugs, or third-party API outages.

Cancellation: You may cancel your subscription at any time via your dashboard to prevent future billing. Upon cancellation, you will retain access to the Service until the end of your current paid billing cycle, after which access will be terminated.

Section 4

Acceptable Use and Account Security

You agree to use Rafeeq only for lawful business purposes. You are explicitly prohibited from using the Service to:

  • Violate any local, national, or international laws.
  • Send unsolicited spam, abusive, deceptive, or unauthorized automated messages.
  • Bypass, overload, or reverse-engineer Rafeeq's infrastructure or billing mechanisms.
  • Violate the terms of service of WhatsApp or any connected platform.

You are solely responsible for maintaining the confidentiality of your account credentials and for all actions taken under your workspace. Rafeeq reserves the right to immediately suspend or terminate your account without notice if you breach any of these rules.

Section 5

AI-Generated Output and Content Ownership

AI Disclaimer:Rafeeq utilizes artificial intelligence to generate responses. AI can produce inaccurate, inappropriate, or outdated information. You bear absolute responsibility for all messages sent by the AI on your behalf. Rafeeq accepts zero liability for any financial, reputational, or legal damages caused by the AI's output.

Data Ownership: You retain ownership of your customer data and the knowledge base content you upload. By using the platform, you grant Rafeeq a license to process and host this data strictly for the purpose of operating the Service.

Section 6

Maximum Limitation of Liability

To the maximum extent permitted by applicable law, Rafeeq is provided strictly on an "as is" and "as available" basis without warranties of any kind.

In no event shall Rafeeq, its founders, employees, or partners be liable for any indirect, direct, incidental, punitive, or consequential damages, including but not limited to loss of profits, loss of data, loss of business opportunities, or damages resulting from third-party platform bans.

If, despite this clause, liability is somehow imposed by a legal authority, Rafeeq's total aggregate liability shall never exceed the total amount paid by you to Rafeeq in the one (1) month immediately preceding the event giving rise to the claim.

Section 7

Modifications to the Terms

We reserve the right to modify these Terms at any time. Updates will take effect immediately upon being posted on our website or platform. Your continued use of the Service following any changes constitutes your absolute acceptance of the revised Terms.

Section 8

Governing Law and Jurisdiction

These Terms, and any dispute arising out of or related to your use of Rafeeq, shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any legal action or proceeding related to this platform shall be brought exclusively in the competent courts located within the Kingdom of Saudi Arabia.
